Kidnapping Charges & Penalties in Louisiana

The degrees of kidnapping charges and penalties vary based on the circumstances of the crime. For example, factors such as whether a weapon was used, harm was caused to the victim, and if you have had any past convictions can all affect sentencing.

Aggravated Kidnapping

Aggravated kidnapping is defined by an instance of one of the following:

  • The forcible seizing and carrying of any person from one place to another
  • The enticing or persuading of any person to go from one place to another
  • The imprisoning or forcible secreting of any person

The above acts must be accompanied with the intent to force the victim, or some other person, to give up something of value, or to grant any advantage or immunity, in order to secure a release of the person under the offender’s actual or apparent control.

This is the most serious kidnapping offense in Louisiana. An individual who commits the crime of aggravated kidnapping will be punished with life imprisonment and hard labor without the benefit of parole, probation, or suspension of sentence.

Second Degree Kidnapping

Second-degree kidnapping is the doing of any of the following acts:

  • The forcible seizing and carrying of any person from one place to another
  • The enticing or persuading of any person to go from one place to another
  • The imprisoning or forcible secreting of any person

While the victim is subject to one or more of the following:

  • Used as a shield or hostage
  • Used to facilitate the commission of a felony or the flight after an attempt to commit or the commission of a felony
  • Physically injured
  • Sexually abused
  • Imprisoned or kidnapped for 72 or more hours (with some exceptions)
  • Imprisoned or kidnapped when the offender is armed with a dangerous weapon or leads the victim to reasonably believe he is armed with a dangerous weapon

A person who commits the crime of second-degree kidnapping will be imprisoned with hard labor for not less than five or more than 40 years. At least two years of the sentence imposed shall be without the benefit of parole, probation, or suspension of sentence.
